Will of Thomas Burgess of Shipton, farmer & farrier, 1829 (proved 1847)

This is the last Will and Testament of me Thomas Burgess late of Whitchurch in the County of Bucks and now of Shipton in the Parish of Winslow in the same County Farmer and Farrier First I give and devise unto my youngest Son William Burgess all that my freehold inclosed plot or allotment of Land or Ground situate \standing and being/ in the Woodfield of Gawcott in the Parish of Buckingham in the said County of Bucks containing five acres two roods and twenty six perches more of less Which descended and came to me as heir at Law of my late Brother James Burgess deceased with the rights members and appurtenances thereunto belonging or in any wise appertaining to hold the same and every part thereof unto and to the use of my said Son William Burgess his heirs and assigns for ever and in case of the decease of my said Son William Burgess under the age of twenty one years and without leaving issue of his body lawfully begotten him surviving I give and devise the said plot or allotment of land or ground with the appurtenances unto my Wife Ann Burgess to hold the same unto the said Ann Burgess for and during the term of her natural life and from and immediately after the decease of my said Wife Ann Burgess (provided the said William Burgess shall have previously departed this life and there shall have been a failure of issue of his body as aforesaid) I give and devise the said plot or allotment of land or ground with the appurtenances unto my oldest Son John Burgess to hold the same unto the use of the said John Burgess and his heirs and assigns for ever and from and immediately after my decease until my said Son William Burgess shall attain the age of twenty one years I do hereby direct authorise and empower my said Wife Ann Burgess to receive and take the rents issues and profits of the said plot or allotment of land or ground the better to enable her to support educate and bring up my said Son William Burgess during his minority Also I give and bequeath unto my said Wife Ann Burgess all my household Goods and Furniture ready money and securities for money Farming Stock both alive and dead book debts \rights/ credits Personal Estate and Effects whatsoever  and wheresoever over which I have a disposing power to hold the same and every part thereof unto the said Ann Burgess her executors administrators and assigns absolutely subject nevertheless to the payment of all such debts as I may justly owe at the time of my decease my funeral and testamentary expences and I do hereby nominate constitute and appoint my said Wife Ann Burgess sole Executrix of this my last Will and Testament In Witness whereof I the said Thomas Burgess the Testator have to the first sheet of this my last Will and Testament contained in two sheets of paper set my hand only and to this the second and last sheet thereof set my hand and seal this ninth day of April on the year of our Lord one thousand eight hundred and twenty nine Thos. Proved at London the 16th Augt. 1847 before the Worshipful Alfred Waddilove Dr. of Laws and Surrogate by the Oath of Ann Burgess Widow the Relict the sole Executrix to whom adm(inistrati)on was granted having been first sworn to duly Administer


Notes

Thomas Burgess' death was registered at Winslow in 1847, aged 59. Apart from the will, he is first recorded in Winslow in 1833 as the tenant of S.G. Dudley in Shipton, and he is recorded there in the 1841 Census with his wife Ann and son William. Ann was still there in 1851. They seem to have lived at what became Shipton Mead.
