Anthony Deely was the younger son of Thomas Deely (d.1686) and with his brother Thomas carried on the family brickmaking business, but before he died at the age of 33 he ran up a remarkable range of debts, presumably not connected with the business.

Notes

The total of the discharge should come to £182 13s 2d.

Inventary: evidently not the one presented in 1691. Thomas must have had other assets apart from the contents of his house, presumably including the value of property which he had mortgaged; see below.

Thomas Kenwricke; see below for the details of this. Margaret did not pay it on time in 1691 but was evidently able to redeem it later.

Surrenders of property, 1690/1

Centre for Bucks Studies, D/97/104/2

This document contains extracts from the manor court rolls of 15 April 1691, confirming transactions made by Anthony Deely shortly before he died. It probably survived because the property came into the hands of the Lowndes family later.

[Latin] Manor of Winslowe with members

View of frankpledge with court baron of Nicholas Goodwin gentleman, held there on 15 April in the 3rd year of the reign of our lord and lady William and Mary, by grace of God king and queen of England, Scotland France and Ireland, defenders of the faith etc., AD 1691, by James Hayes esq. deputy seneschal there.
At this court the jurors with the homage on their oath reported that Anthony Deely, one of the customary tenants of the manor, died since the last court, and that Anthony before he died, out of court and since the last court, namely on 2 January last, surrendered into the hands of the lord of the manor through the hands of Joseph Glenister and Robert Udden, two customary tenants of the manor, by rod according to the custom of the manor, all the close of meadow or pasture lying and being in Winslowe next to the graveyard (sepulchretum) there, and adjoining The Brickyard of the said Anthony Deely, along with all roads, waters, watercourses and appurtenances whatsoever belonging and pertaining to the same.  To the benefit and use of Thomas Kenwrick of Winslow in Bucks Apothecary, his heirs and assigns forever.  Providing always and under this condition, that if Anthony Deely, his heirs, executors, administrators and assigns or any of them well and truly pays or causes to be paid to the said Thomas Kenwrick, his executors or assigns, the full sum of £30 7s 6d of legal money of England on 3 April following the date of the surrender, without fraud or further delay, at or in the south porch of the parish church of Winslowe, then the surrender is to be void, otherwise to remain in full force and strength.  And the jurors with the homage further reported that the aforesaid sum of £30 7s 6d according to the form and effect of the condition of the surrender specified above was not paid nor has yet been paid.  Therefore the premisses became forfeit to Thomas Kenwrick.  And now to this court came Nicholas Merwin of Winslowe, gentleman, attorney of the said Thomas Kenwrick, legitimately appointed as appears fully by his letters under his hand and seal shown here in court.  And he sought to be admitted tenant to the premisses.  To which Nicholas, attorney of Thomas Kenwrick, the lord through his seneschal granted seisin thereof by rod, to have and hold to the said Thomas Kenwrick and his heirs by rod according to the customs of the manor, and according to the form and effect of the surrender, by annual rent of [blank], suit of court, heriot and other services previously due and rightly accustomed therefor.  And he paid the lord as a fine for having such standing and entry thereto 1s 6d, but fealty was respited until etc.
[another hand] Executed by James Hayes deputy seneschal there

[1st hand]  And also at this court it was found by the jurors with the homage on their oath that the aforesaid Anthony Deeley since the last court, out of court and before his decease, namely on 6 March last, surrendered into the hands of the lord of the manor by rod, through the hands of Richard Phipps and Thomas Deely, two customary tenants of the manor according to the custom of the manor, all those his two messuages or tenements standing and being together near the graveyard of Winslowe, one of them in Anthony’s own occupation and the other lately in the occupation of Anne wife of Henry Wyatt, the messuage or tenement of Peter Lowndes lying on the south side.  And also all that close of meadow or pasture adjoining and belonging to the messuages or tenements, the graveyard lying on the east side and The Brickyard of Anthony Deely lying on the east side, with all trees, woods, underwoods, roads, waters, easements of light, common benefits and appurtenances whatsoever belonging or in any way pertaining to them.  To such use, intention and purpose as is delimited, appointed and declared by Anthony Deely’s last will and testament, and to no other use, intention or purpose whatsoever.  And now to this court came Margaret Deely widow, lately Anthony’s wife, and brought forth here in court the testament and last will of Anthony Deely her husband deceased, bearing date 6 March last, the tenor of which will as far as the customary lands and premisses follows in these words:

[English] Whereas I doe owe and stand indebted unto the severall persons herein after named in the severall summs of money herein after expressed (that is to say) unto Mr Thomas Kenwrick the summe of Thirty pounds unto William Hancock the summe of twenty pounds unto Thomas Woodward the summe of seaven pounds and John Banes and Thomas Roades the summe of Twelve Pounds And haveing surrendered the premisses herein after mencioned to the Use of my Will my will and Meaneing is and I doe hereby give devise and bequeath unto Margerett my Loveing wife her Heires and Assignes forever All those my Two Mesuages Cottages wherein I doe dwell and wherein Ann Wyatt lately did dwell with the Close thereunto adjoyneing and belonging with all proffitts and appurtenances to the said Mesuage and Close belonging in the said recited Surrender particularly mencioned and expressed  And my will and desire Farther is that such of the said partyes who have mortall Surrender of any parte of my said estate for the payment of any of the said summes of money shall upon payment thereof surrender and release the premisses soe Assured to them to the said Margerett my wife her Heires and Assignes forever or to such person or persons as she the said Margerett my wife shall direct and appoint by writing under her hand and seale to be Attested by two or more credible Wittnesses

[Latin] as by the last will and testament of Anthony Deely more fully is declared and appears.  The which Margaret, present here in court, sought to be admitted to the premisses.  To whom the lord through his seneschal granted seisin thereof by rod, to have and hold to herself and her heirs by rod according to the customs of the manor, and according to the form and effect of the surrender and will, by annual rent of 1s 3d, suit of court, heriot and other services previously due and rightly accustomed therefor.  And she paid the lord as a fine for having such standing and entry thereto 10s, and did fealty to the lord.  And she was admitted tenant thereof.
[2nd hand] Executed by James Hayes deputy seneschal there

Notes

Anne wife of Henry Wyatt: Anthony's sister.

Presumably an error for west, as the graveyard must be on the east.

mortall Surrender: i.e. a surrender of property to take effect on Anthony's death. Anthony must have held other property which he used as security for his debts.

Anthony, bap. 1657, was married before 1682 to Margaret (original surname not known). He appears to have lived in Church Street (perhaps the site of Pear Tree Cottage), with his brickyard to the west, presumably extending to the grounds of the vicarage.  Some property was also mortgaged to Daniel and Ann Stevens. Despite her husband’s heavy debts Margaret was able to keep the brickmaking business going as she was one of the suppliers of bricks for Winslow Hall in 1700.  She was buried on 11 July 1707. Anthony and Margaret had these children:
