Will of Catherine Holt, widow, 1866 (proved 1871)

This is the last Will and Testament of me Catherine Holt late of Sharps Hill in the Parish of Ludgershall in the County of Bucks, but now of Winslow in the same County Widow made this Ninth day of April in the year of our Lord One thousand eight hundred and sixty six I appoint William Cross of Edgcott in the said County of Bucks Farmer and John Joseph Dodge of Steeple Claydon in the same County Farmer joint Executors of this my Will And I give devise and bequeath to the said William Cross and John Joseph Dodge their heirs executors administrators and assigns all estates vested in me as a mortgagee [or] trustee to be held Upon and for \the/ trusts and purposes for which the same respectively may be held by me I give devise and bequeath to the said William Cross and John Joseph Dodge the sum of four hundred pounds Sterling free of Legacy duty Upon trust to pay the interest thereof from the day of my decease to my Sister Mary Ann Edmunds during her life And as to all my household goods and furniture plate linen and china And as to all other my monies and securities for money arrears of rent and all other my personal estate whatsoever And also (after the decease of my said sister) [as] to the said principal sum of four hundred pounds I give and bequeath the same and every part thereof to my nephew Robert Edmunds the son of my said Sister Mary Ann Edmunds his heirs executors administrators and assigns absolutely And I declare that it shall be lawful for the trustees or trustee of this my Will to invest or continue invested the said monies held under the trusts of this my Will in or upon such stocks funds debentures or other real or personal securities as they or he shall think proper and at their or his discretion to alter vary and change the stocks funds or securities in or upon which such monies or any part thereof may be invested And I further declare that if the trustees of this my Will or either of them shall die in my lifetime or at my decease shall refuse decline to accept or be incapable of accepting the trusts of this my Will or if the said trustees or either of them or any future trustee or trustees shall at any time go to reside abroad … [the Will goes on to list various provisions for retiring, refusing and incapable trustees and their replacements] … And I further declare that my said trustees and executors shall not be chargeable with any further monies or effects than they respectively shall already receive and that any one of them shall not be answerable or accountable for the other of them nor for any involuntary loss and that it shall be lawful for them respectively out of the monies held under the trusts of this my Will to reimburse themselves and each other all such costs charges damages and expenses as they respectively shall incur sustain or be \put/ unto in or about the execution of the trusts of this my Will or in any matter relating thereto In Witness whereof I have hereunto set my hand the day and year before written

This is a Codicil of the last Will and Testament of me Catherine Holt of Winslow in the County of Bucks Widow which Will bare date Ninth day of April in the year of our Lord One thousand eight hundred and sixty six I revoke my former Will so far as this that is to say I appoint my Nephew Robert Edmans of Edgcott in the said County of Bucks to be my Executor in room of the late William Cross deceased and I confirm my Will in all other respects In Witness whereof I have hereunto set my hand Twenty sixth day of February  in the year of our Lord One thousand eight hundred and sixty eight

Proved at London (with a Codicil) 18th May 1871 by the oaths of John Joseph Dodge the Executor named in the Will and Robert Edmans the nephew the Executor named in the said Codicil to whom adm(inistrati)on was granted

ON the 18th day of May 1871 the Will with a Codicil thereto of Catherine Holt late of Winslow in the County of Buckingham Widow deceased, who died the 20th day of March 1871, at Winslow aforesaid, was proved in the Principal Registry of Her Majesty’s Court of Probate, by the Oaths of John Joseph Dodge of Steeple Claydon in the said County Farmer the Executor named in the said Will and Robert Edmans of Edgcott in the said County  Victualler and Farmer the Nephew of the said deceased the Executor named in the said Codicil they having been first sworn duly to administer.

Notes

Catherine Holt does not appear in Winslow in the 1871 Census or the 1869 Post Office Directory. In 1861 she was living at Ludgershall with her husband John Holt, a farmer. She was then aged 57 and born at Flecknoe, Warws.
