Will of Robert Ivatts, grocer and tallow chandler, 1812 (proved 1821)

This is the Last Will and Testament of me Robert Ivatts of Winslow in the County of Bucks Grocer and Tallow Chandler First I Will and direct that all such Debts as I shall justly owe at the time of my decease my Funeral and Testamentary expences be fully paid and satisfied And I give and devise unto my esteemed friend Francis Goode of Buckingham in the said County of Bucks Gentleman and my two Nephews Benjamin Holland and Thomas Ivatts (Son of my late Brother Thomas Ivatts and Alice his Wife) All that my Messuage  or Tenement situate standing and being in Winslow aforesaid wherein I now dwell with the respective Rights Members and Appurtenances thereunto belonging or in any wise appertaining (Which said premises are Copyhold of Inheritance held of the Manor of Winslow with its Members & have been already surrendered to the use of my Will) To Hold the same unto and to the use of the said Francis Goode, Benjamin Holland  and Thomas Ivatts my Nephews their Heirs and Assigns Upon Trust nevertheless as hereinafter mentioned Also I give and bequeath unto my Neice Susanna Holland the Bed and Bedstead I usually lie on with the furniture and all other Apparatus thereto belonging And all my Linen Plate and China and all my furniture of every description which usually is and standeth in my Bed Chamber wherein I commonly sleep Also I give and bequeath unto the said Susanna Holland the Legacy or Sum of three hundred pounds of lawful British Money Also I give and bequeath unto my Nephew and Niece Charles Ivatts and Sarah Ivatts (the Son and Daughter of my late Brother Joseph Ivatts and Mary his Wife) the Legacy or Sum of One hundred pounds each which said Legacies or Sums of Money above mentioned I direct to be paid to the said several and respective Legatees within twelve months next after my decease or when and so soon after as they shall attain their respective Ages of twenty one years And in the meantime from and after my decease and until the said Legacies shall respectively become due and payable I authorise and empower my Trustees and Executors hereinafter named and the Survivors or Survivor of them and the Executors and Administrators of such Survivor to place out and invest their said Legacies in his her or their own Name or Names in or upon Government or real Securities as he she or they shall think fit In Trust for the said Susanna Holland Charles Ivatts and Sarah Ivatts and to pay and apply the Dividends and Interests thereof for and towards their Several and Respective Maintenance and Education And my Mind and Will also is in case of their decease of either of them the said Charles Ivatts and Sarah Ivatts before his or her Legacy shall become due and payable Then that the said Legacy of him or her so dying shall belong to the Survivor of them the said Charles Ivatts

[f.2] And Sarah Ivatts and be paid assigned or transferred to him or her at the same time his or her Original Legacy shall become due and payable And in case of the decease of both of them the said Charles Ivatts and Sarah Ivatts or the said Susanna Holland before their or her said Legacy or Legacies shall become due and payable Then my mind and Will is and I do direct that that their or her said Legacies shall become due and payable Then my mind and Will is and I do direct that their or her said Legacies or Legacy shall lapse and sink for the Benefit of my Sister Frances Holland Widow during her Life and after her decease for the Benefit of my Nephews and Nieces hereinafter mentioned in like manner as hereinafter is mentioned and expressed respecting the residuum of my Monies to arise and be made by the Sale and disposition of my real Estates and residue of my personal Estate and Effects as hereinafter mentioned and expressed And I do hereby further Will order and direct my Executors and Trustees hereinbefore named or the Survivor of them his Executors or Administrators within twelve months next after my decease to pay unto my Sister-in-Law Alice Ivatts Widow of my said late Brother Thomas Ivatts or such other person or persons who shall then be intitled to receive the same, the sum of One hundred pounds which was given and bequeathed to him my said Brother Thomas Ivatts in and by the last Will and Testament of my late Brother William Ivatts deceased and thereby directed to be paid by me within ten Years next after the decease of the said William Ivatts And as to the rest and residue of my Household Goods and Furniture Linen [space] Stock and Implements in Trade ready Money and Securities for Money book debts Goods Chattels Rights Credits Personal Estate and Effects whatsoever and wheresoever and of what nature or kind soever (not hereinbefore by me otherwise disposed of) I Give and bequeath the same and every part thereof unto the said Francis Goode Benjamin Holland and Thomas Ivatts my Nephews To Hold the same unto the said Francis Goode Benjamin Holland and Thomas Ivatts my Nephews their Executors Administrators and Assigns Upon Trust that they the said Francis Goode Benjamin Holland and Thomas Ivatts or the Survivors or Survivor of them or their Heirs Executors Administrators or Assigns of such Survivor Do and shall as soon as conveniently maybe after my decease sell and dispose of the said Messuage or Tenement Hereditaments and Premises And also the rest and residue of my said Personal Estate and Effects for the most Money and best Price or Prices that can be reasonably had or gotten for the same and the money arising by the sale and disposition thereof In the first place to pay off and discharge my said Debts funeral and testamentary expences and the several and respective Legacies or Sums of Money by me hereinbefore given and bequeathed and directed to be paid as aforesaid Then Upon Trust (after the said Francis Goode shall have retained the sum of five pounds which I desire and

[p.3] Request him to do as a small token of respect and for the care and Trouble he will have as one of my Executors and Trustees and Paying satisfying and discharging the costs and charges incident toward attending the Sale and disposition of my said Copyhold and personal Estates that they the said Thomas Goode Benjamin Holland and Thomas Ivatts or the Survivors or Survivor of them or the Executors or Administrators of such Survivors Do and shall place out and invest what shall be remain [sic] of the said Monies upon Government or such Security or Securities at Interest and do and shall stand and be possessed and interested in the said Securities upon which the same or any part thereof shall be placed out and the Interest and the annual produce thereof (all and every which said Security or Securities shall and maybe altered varied transferred Assigned and disposed of and the monies thereby arising again placed out lent and advanced in or upon new or other Securities as aforesaid) Upon Trust to pay the Interest thereof into the Hands of my said Sister Frances Holland or otherwise to permit and suffer her to receive the same during the term of her natural Life And from and immediately after the decease of my said sister Frances Holland Upon Trust that they the said Francis Goode Benjamin Holland and Thomas Ivatts or the Survivor or Survivors of them or the Executors or Administrators of such Survivor Do call in and receive the said Monies so to be placed out as aforesaid (or so much and such part thereof as shall then be Necessary) and pay and divide the same unto and among themselves the said Benjamin Holland and Thomas Ivatts and all and every other my Nephews and Nieces the Children of my said late Brother Thomas Ivatts and Alice his Wife my Brother James Ivatts and Rachel his Wife and my said Sister Frances Holland (except the said Susanna Holland) equally share and share alike and which I do hereby also give and bequeath to them my said Nephews and Nieces  respectively accordingly with benefit of Survivorship amongst them  as to the Share or Shares of any or either of them dying before his her or their said Legacy or Legacies shall become due and payable and also do direct the same to be paid to such of them as shall at the time of the decease of my said Sister Frances Holland  have arrived to the age of twenty one years as soon as conveniently may be after the same And to each of them as shall not \then/ have arrived to that age when and so soon as they shall severally and respectively attain thereto And my Mind and Will also is and I do declare and direct that the Receipt or Receipts and Benefits of the said Francis Goode Benjamin Holland and Thomas Ivatts my Nephews or their Heirs shall be sufficient discharge or Discharges to the Purchaser or Purchasers of my said Copyhold Estate hereinbefore given and devised to them for so much money as in and by such receipt or receipts shall be expressed to be received And that it shall not be necessary for the Purchaser or Purchasers thereof his her or their Heirs or Assigns to see to

[p.4] The application of his or their Purchase Money nor be answerable for the Misapplication or nonapplication thereof or any part thereof And I do hereby Constitute and Appoint the said Francis Goode and Benjamin Holland and Thomas Ivatts my Nephews the Executors of this my last Will and Testament hereby annulling all former and other Wills by me at any time heretofore made And my Will is and I do hereby direct that my said Executors and Trustees shall each of them be answerable for his own Acts and Deeds only and not the one of them for the other of them and that they or either of them shall not be answerable for any more of the Monies or produce of my Estates than shall be actually received by them or come to their respective hands or Use nor for any Loss or Reduction therein without their or one of their wilful neglect or Default And also that they shall retain all their Costs Charges Damages and Expences in the Trusts or Executorship of this my Will out of the Estates and Effects in them respectively vested by virtue thereof or out of the Monies arising therefrom In Witness whereof I the said Robert Ivatts the Testator have to this my last Will and Testament contained in four Sheets of paper at the bottom of each of the first three sheets set my Hand and to this fourth and last sheet thereof my hand and seal this seventh day of August in the year of our Lord One thousand eight hundred and twelve

The twenty ninth day of October 1821 Francis Goode and Benjamin Holland two of the Executors in this Will named were duly sworn as such And that the personal Estate of the testator doth not amount in the whole to the sum of £1500 to the best of their knowledge and belief Power being reserved for Thomas Ivatts the other Executor to administer when he shall apply for that purpose

The Ivatts brothers ran the grocery business at 1 Horn Street until Robert's death in 1821. See the will of William Ivatts (proved 1806). They acquired it after the death of the previous owner, their brother-in-law John Redding Holland (d.1805), but probably ran it before then as he lived in Aylesbury at the time of his death. Frances Holland the widow was living in Winslow when she made her will in 1812, presumably with her brother. The other members of the family seem to have lived in Aylesbury. Robert Ivatts' furniture was put up for auction on 14 Sep 1821.
