ON the seventeenth day of November 1884, the Will with a Codicil thereto of James King late of Winslow in the County of Buckingham, Gamekeeper, deceased, who died on the Fifteenth day of March 1884, at the Infirmary in the City of  Oxford, was proved in Her Majesty’s High Court of Justice in the District Registry attached to the Probate Division thereof at Oxford by the Oath of George Davys Edward Wigley of Winslow aforesaid, Land Agent, one of the Executors named (in the said Will) he having been first sworn duly to administer. Joshua Lewin French (heretofore the Younger) the other Executor and one of the residuary Legatees in trust named in the said Will, having renounced the Probate and execution of the said Will and Codicil.
It is hereby certified that the above is a correct Copy. Dated this Twenty seventh day of November 1884.

This is the last Will and Testament of me James King of Winslow in the County of Bucks, Gamekeeper, made this Thirtieth day of September in the year of our Lord One thousand eight hundred and seventy one. I appoint Joshua Lewin French the Younger of Winslow aforesaid, Ironmonger, and George Davys Edward Wigleyof the same place, Land Agent, joint Executors of this my Will. And I give devise and bequeath to the said Joshua Lewin French the Younger and George Davys Edward Wigley their heirs executors administrators and assigns All estates vested in me as Trustee or Mortgagee to be held upon and for the trusts and purposes for which the same respectively may be held by me I give and bequeath all my household goods and furniture plate linen china books and apparel unto my Wife Catherine Geary King absolutely. I give devise and bequeath all my Messuages lands tenements and hereditaments and parts and shares of Messuages lands tenements and hereditaments whatsoever and wheresoever and of whatsoever tenure the same may be with their respective appurtenances and also all my monies and securities for money an all other my effects and personal estate not hereinbefore bequeathed subject to the payment of my just debts and funeral and testamentary expenses unto the said Joshua Lewin French the Younger and George Davys Edward Wigley their heirs . . . Upon trust to convert into money all such of my personal estate as shall not be of a pecuniary nature And to stand possessed of all my Messuages Lands Tenements . . . Upon trust to let or concur with any other person or persons in letting the same and to receive the rents profits interest and income of my said real and personal estate respectively and after providing for repairs and insurance against loss by fire to pay out of such rents profits . . . to my said Wife Catherine Geary King the sum of One pound weekly and every week during her life the first weekly payment to become due to my said Wife on the first Monday next after my decease And to pay unto my Daughter Kate Elizabeth King (by my first Wife) if and when she shall attain the age of twenty two years the sum of Five hundred pounds sterling and to my Daughter Hannah King (by my present Wife) [an identical legacy] And I give and bequeath the said sums of money to my said Daughters accordingly And subject to the payment of the said sums of money . . . if and when the same respectively shall become payable and to the payments hereinbefore directed to be made to my said Wife I direct my said Trustees . . . to stand possessed of all my said real and personal estate Upon trust for my two Sons Orlando James King and Theodore William King as tenants in common and for their respective heirs . . . absolutely. And in case of the death of either of my said Sons under the age of twenty two years then I direct that the share of the Son so dying under that age shall be held In trust for the other of my said Sons his heirs . . . And in case of the death of both of my said Sons . . . Then I direct that the said real and personal estate shall be held In trust for my said Daughters Elizabeth King and Hannah King as tenants in common and for their respective heirs . . . And in the case of the death of either of my said Daughters under the age of twenty two years [identical provision is made as applied earlier to the Sons] And I direct that while any of my said children shall be under the age of twenty two years the income arising from his her or their presumptive Legacy or property . . . shall be paid unto my said Wife during her life to be applied and in case of my said Wife’s death shall be by the Trustees or trustee of this my Will applied for or towards the maintenance education benefit and advancement of my said child or children respectively And all such payments shall be allowed in the accounts of my said Trustees . . . notwithstanding the death of any child . . . before having acquired a vested interest in my property or some part thereof And I further direct that the Trustees . . .  may lay out and invest any monies held under the trusts of this my Will in or upon Government real securities in Great Britain or upon India Stock or Bonds Colonial Government Securities Railway or other Debentures or Debenture Stock Preference Railway or other Stock or shares and may from time to time at discretion alter vary and change the Stocks funds and securities in or upon which the said trust monies or any part thereof may be invested And I also declare that it shall be lawful for the Trustees . . . either for the purpose of easy division or for any other purpose that they . . . think proper shall sell or dispose of and to concur in the sale and disposal of the hereditaments and premises hereinbefore devised. In trust as aforesaid or any of them either together or in lots and by public auction or private contract or in such other manner in all respects and under such conditions and stipulations as to title as they . . .shall think fit with liberty to buy in the same or any part thereof at any auction and to rescind or vary the terms of any contract and to sell the premises so bought in or the contract for the sale whereof shall be rescinded in manner aforesaid without being answerable for any loss or diminution in price and to convey or assure . . .the said hereditaments parts shares or premises or any part of them when sold to the purchaser or purchasers thereof and to his her or their heirs . . . And I declare that the monies arising from such sale . . . (after first satisfying thereout the costs charges and expenses attendant thereon) shall be held by my said Trustees upon the same trust as the premises which shall be so sold or disposed of subject to such variation only as a change from real to personal estate shall require And I further declare that the receipt . . . in writing of the Trustees . . . shall be a good and sufficient discharge . . . for the rents and profits for the premises devised as aforesaid for the rents . . .or for any other monies paid to the said Trustees . . . under or by virtue of  . . my Will for the money thereby expressed to be received and shall effectually discharge the person . . . paying for the same from all liability to see to the application or on account of the misapplication or nonapplication thereof Provided also and I further direct that the Trustees . . . shall have power to lease . . . the said hereditaments  . . . held under the trusts of this my Will or any of them for any term not exceeding fourteen years in possession at such rent and under such conditions . . . as the said Trustees shall think proper so that no fine shall be taken for the same  Provided also and I further declare that in case the Trustees hereby appointed . . . shall die in my lifetime or shall at my death be resident abroad or renounce decline to act or be incapable of acting in the trusts of this my Will or if they. . . or any Trustee . . .to be appointed under the present provision shall after my decease die go to reside abroad or desire to be discharged from or shall neglect or shall refuse or become incapable to act in the trusts . . . before the same can be fully performed . . . then it shall be lawful for the surviving . . . Trustee . . . to appoint any person . . . to supply the place of the Trustee. . .so dying renouncing . . . as aforesaid and that the said trust estate shall thereupon be conveyed and transferred so that the same may vest in such new Trustee . . . with the surviving or continuing Trustee . . .or solely as the case may require upon the trusts hereinbefore declared and that every such new Trustee shall have and may exercise the same powers and authorities as if he had been appointed a Trustee by this my Will. In Witness whereof I have to each sheet of this my Will contained in five sheets of paper set my hand the day and year first before written.

This is a Codicil to the last Will and Testament of me James King of Winslow in the County of Buckingham, Gamekeeper made this Eleventh day of December One thousand eight hundred and seventy five my said Will bearing date the thirtieth of September One thousand eight hundred and seventy one Whereas since the date and execution of my said Will my Wife Catherine Geary King has departed this life And whereas I have by my . .  .Will directed the Trustees . . . to pay to my Daughter Kate Elizabeth King  . . . if and when she shall attain the age of twenty two years the sum of Five hundred pounds . . .and to my Daughter Hannah King [previous wording repeated] And I do hereby direct that the Trustees pay to my said Daughter Kate Elizabeth King  . . . if and when she shall attain the age of twenty two years the further sum of One hundred pounds . . . [identical provision made for second daughter Hannah] And I give and bequeath the said further sums to my said Daughters respectively accordingly and in case of the death of either of my said Daughters under the age of twenty two years I direct the money that would otherwise have been payable to my . . . Daughter so dying . . . shall be held In Trust for the other . . .  Daughter if she shall attain the age of twenty two years And I direct that the Trustees of my . . .  Will shall have the same power to apply the income of the said respective sums of One hundred pounds and [sum repeated] for the maintenance education . . .of my said Daughters . . . as by my  . . .Will given with respect to the income of the respective sums of Five hundred pounds and [sum repeated] thereby directed to be paid to my . . . Daughters . . .  And I further direct that the said sums of Five hundred pounds and [sum repeated] and One hundred pounds and [sum repeated] shall carry interest at the rate of Five pounds per Centum per annum from the day of my decease In Witness whereof I have herewith set my hand the day and year first before written.

Proved at Oxford with a Codicil, the Seventeenth day of November 1884, by the Oath of George Davys Edward Wigley one of the Executors named in the Will to whom Administration was granted. Joshua Lewin French (heretofore the Younger) the other Executor and one of the residuary Legatees in Trust named in the said Will, having renounced the Probate and execution of the said Will and Codicil.
The Testator James King was late of Winslow in the County of Buckingham, Gamekeeper, and died on the Fifteenth day of March 1884, at the Infirmary in the City of Oxford.

Notes

James King was born at Whitfield, Northants, and probably wasn't related to James King the auctioneer who lived in Winslow at the same time. He was gamekeeper for the Winslow Hall estate. He came to Winslow in about 1852. In 1881 he was aged 62, and was living at 11 Sheep Street with his children Kate aged 22 (housekeeper), Theodore aged 20 (assistant gamekeeper) and Hannah aged 15 (general servant). He was living in the same house in 1861 with his first wife Ann (aged 30, b. Thornborough, nee Reynolds). His second wife Catherine was also from Thornborough. He owned the land called Townsend Close which is now Greyhound Lane car park and was sold after his death (read more).

In the 1891 Census the three siblings were living at Whaddon with their brother Orlando, a farmer.
