Will of Henry Stock, farmer, 1941 (proved 1944)

BE IT KNOWN that Henry Charles Stock of Oak Lodge Winslow in the County of Buckingham, died on the 13th day of December 1943 at the Ackland Home in the City of Oxford.

AND BE IT FURTHER KNOWN that at the date hereunder written the last Will and Testament (a copy whereof is hereunto annexed) of the said deceased was proved and registered at the District  Probate Registry of His Majesty’s High Court of Justice at Oxford and that the Administration of all the Estate which by law devolves to  and vests in the personal representative of the said deceased was granted by the aforesaid Court to  Frederick Henry Stock of Rovendon, Cranbrook in the County of Kent drainage official and Ethel Ada Stock and Edith Annie Stock both of Oak Lodge aforesaid spinsters children of the deceased the executors named in the said will.
And it is hereby certified that an Affidavit for Inland Revenue has been delivered wherein it is shewn that the gross value of the said Estate of Great Britain (exclusive of what the said deceased may have been possessed of or entitled to as a Trustee and not beneficially) amounts to £7508 : 2 : 4 and the net value of personal estate £1990 : 16 : 3

And it is further certified that it appears by a Receipt signed by an Inland Revenue Officer on the said Affidavit that £278 : 2 : 0 on account of Estate Duty and Interest on such duty has been paid.

THIS IS THE LAST WILL of me HENRY CHARLES STOCK of “Oak Lodge” Winslow in the County of Buckingham Farmer 1. I REVOKE all other Wills and testamentary dispositions by me heretofore made 2. I APPOINT my Son FREDERICK HENRY STOCK and my Daughters ETHEL ADA STOCK and EDITH ANNIE STOCK (hereinafter called “my Trustees”) to be the Executors and Trustees of this my Will 3. I BEQUEATH to my Wife Emma Elizabeth Stock absolutely free of duty all my personal effects and all my furniture and household effects 4. AS to all the rest residue and remainder of my estate and effects both real and personal I GIVE DEVISE AND BEQUEATH the same unto my Trustees UPON TRUST that my Trustees shall (subject to the provisions hereinafter contained relating to the business of a Farmer and Dairyman now carried on by me at Winslow aforesaid) sell and convert into money my real and personal estate and shall hold the money to arise from such sale and conversion and any ready money I may die possessed of IN TRUST to pay my debts and funeral and testamentary expenses and to invest the surplus of the said moneys (hereinafter called “my Trust Estate”) in such investments as may be authorised by law for the investment of trust funds AND UPON FURTHER TRUST to pay the whole annual income of my trust estate (including my said business and any other part of my Trust Estate remaining unconverted) as from the date of my decease to my said wife during her life 5. From and after the decease of my said wife I DECLARE that my Trustees shall hold my Trust estate and the income thereof IN TRUST for all my children in equal shares subject nevertheless as to the share of my daughter May Rose King to the provisions hereinafter contained concerning the same 6. PROVIDED ALWAYS that if any child of mine shall die in my lifetime leaving issue who shall survive me and who shall attain the age of twenty one years such issue shall take (and if more than one equally between them) the share which their his or her parent would have taken of and in my trust estate if such parent had lived to attain a vested interest 7. I DIRECT that  my Trustees  shall stand possessed of  the share of my said daughter May Rose King or the investments representing the same UPON TRUST to pay her a capital sum of Fifty pounds immediately upon the death of my said wife and thereafter the income produced by the residue of such share during her life and after her death to hold the same upon trust for all or any her children or child who attain the age of twenty one years and if more than one in equal shares 8. WITH respect to the said business of a farmer and dairyman now carried on by me my Trustees may continue the same for as long as they may think fit or discontinue the same at any time and wind up the affairs thereof with proper power for my Trustees if and so long as they shall continue the business to employ the whole or any part of the capital which shall be employed therein at my death and also such further part of my estate as they shall think expedient and with power also to employ my son in law Philip Hazelton or any other person as manager and generally to act in the conduct of the said business as they shall in their absolute discretion think fit without being answerable for any loss arising thereby and during the continuance of such business by my Trustees the net profits arising therefrom shall be applied in like manner as income arising from investments forming part of my Trust Estate 9. AND I DECLARE that no sale of my real estate or any part thereof shall be made in the lifetime of my said wife without her previous consent in writing and that my Trustees shall have a discretionary power to postpone for such period as to them shall seem expedient the conversion or getting in of any part of my residual estate  IN WITNESS whereof I have to this my Will set my hand this First day of October One thousand nine hundred and forty one
