Will of Richard Barton junior, 1830

This will has not been traced in any of the usual probate records but was copied into the Winslow Court Book for 1830.

… And it is further found and presented by the Homage aforesaid upon their Oath that the said Richard Barton the Son and Devisee of the said Richard Barton deceased also died since the last General Court holden for this Manor, and since the death of his said Mother without having been admitted Tenant to the Copyhold premises so devised to him by the Will of his said Father Richard Barton or to the said Barn consisting of two Bays situate in Winslow aforesaid \which/ descended and came to him as the eldest Son and Customary Heir of his said Father (the reversion whereof after the death of the said Ann Barton his Widow was not disposed of by his Will) having first duly made and published his last Will and Testament in writing bearing date the eight day of June one thousand eight hundred and thirty whereby he gave and devised unto his Sisters Mary Ann Barton and Sarah Barton the said Messuage or Tenement and also the said Stable so devised to him by his said Father as aforesaid and all other his real Estates whatsoever and wheresoever To hold to his said Sisters Mary Ann Barton and Sarah Barton their heirs and assigns for ever as Tenants in Common and not as joint Tenants Subject nevertheless to and charged with the payment of the Legacy or Sum of Two hundred pounds in and by the said Will of his said late Father Richard Barton contingently given to his said Sister Mary Ann Barton and charged on the said Hereditaments and premises hereinbefore given and devised and also subject to and charged with the Legacy to his said Brother Alfred Barton therein mentioned

Now to this Court comes the said Mary Ann Barton one of the two Sisters and Devisees named in the said Will of the said Richard Barton the younger in her own proper person and desires of the Lord of this Manor to be admitted Tenant to one undivided Moiety or half Part or Share the whole into two equal Moieties or half parts parts or Shares to be divided of and in the said Messuage or Tenement and Stable specifically devised by and also the said Barn of two Bays to which they also became entitled under the Will of their said Brother To whom the Lord of this Manor by the hands of his said Steward grants seizin thereof by the Rod To have and to hold the said the one undivided Moiety or half Part or share of and in the premises aforesaid with the appurtenances unto the said Mary Ann Barton her heirs and assigns for ever Subject nevertheless to the charges with Payments of the said Will of the said Richard Barton the younger mentioned and contained of the Rod at the Will of the Lord according to the Custom of this Manor by the yearly rent of two pence halfpenny Fealty, Suit of Court, Heriot and other Services and customs therefore due and of right accustomed she gives to the Lord for a Fine for such her Estate so to be had in the premises Five shillings and she is thereof admitted Tenant &c. and her Fealty is respited until &c. Notes

The Barton family kept The George. Richard was buried on 28 Aug 1830, aged 24. The inn itself was freehold and didn't come within the jurisdiction of the manor court. Either by other provisions in Richard jr's will or by the rules of inheritance, it passed to Richard's younger brother Alfred Barton.

Mary Ann and Sarah were still living with Alfred at The George in 1841. Sarah married Samuel Cole of Tuckey Farm in 1845. Mary Ann was lodging at 27 Market Square in 1851, and died in 1857.
